Customer is responsible for all shipping and handling charges as outlined in Freight Policy and Big Reel Deposits sections of these Terms, Conditions, and Ordering Information. Rain Bird will utilize commercially reasonable efforts to ship products so that they are delivered to the customer-designated locations within the requested period of delivery dates, however orders must be placed with sufficiently reasonable lead time, as determined by Rain Bird, to accommodate the requested delivery date using the requested shipping method. Any advance information as to the shipping or delivery date will be an approximation. Delivery estimates are made in good faith and are subject to delay due to government restrictions, failure of Rain Bird’s suppliers to deliver, fires, strikes, or other causes beyond Rain Bird’s control. Palletized product typically requires a forklift or similar equipment to unload. Equipment and labor necessary to unload products are the responsibility of the customer. If special handling, equipment, or labor are requested by the customer at the time of order, any applicable fees will be added to the customer invoice if paid by Rain Bird.

Customer acknowledges responsibility for inspecting all products and quantities or shortages within fifteen (15) days of receipt and notifying Rain Bird within the fifteen (15) day inspection period of any alleged nonconformity. Any failure to notify Rain Bird within the fifteen (15) day period shall be deemed a waiver of customer rights to reject the product. Customer acknowledges and agrees that Rain Bird will have the opportunity to verify and/or resolve any alleged nonconforming product shipment within a commercially reasonable amount of time. Customer acknowledges that the risk of loss of product during transit is the responsibility of the customer, and Rain Bird shall not be liable for any damage or loss occurring during product shipment. Any claims for such damages or loss must be filed with the freight carrier directly.
